These are the general Terms of Use for this website and/or the corresponding WAP or mobile website (together, the 'Website' or 'Site') that is operated by or on behalf of MTAG. These Terms of Use include the Privacy Policy displayed elsewhere on the website, and govern the provision and use of any or all services offered via the mobiletag website or accessible by a mobile device (the 'Services'). By using the site or any of the mobiletag software and services, you agree to be bound by these Terms of Use. The Terms of Use start on the date that you first begin using the site and will continue until your access to our services has terminated. We reserve the right, at our discretion, to update or revise these Terms of Use at any time without notice. Please check periodically for changes. Your continued use of this site following the posting of any changes to the Terms of Use constitutes your acceptance of those changes. The non-respect of one or several of the Conditions of Use automatically puts an end to your authorization to use this Site and you must then immediately delete all Materials downloaded or printed from the Site.

Site Use.
Unless indicated otherwise in any other place on the Site, you are authorised to consult, download and print the documents and information available on the Site on the following conditions :

MTAG grants you a personal, non-transferable and non-exclusive right and license to use the software on a single mobile device; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the software. You agree not to modify the software in any manner or form, or to use modified versions of the software, including (without limitation) for the purpose of obtaining unauthorized access to the service. You agree not to access the service by any means other than through the interface that is provided by MTAG for use in accessing the service. You further acknowledge that the content presented to you through the services is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws ("Rights").
Mobiletag reserves the right to deny the authorization to consult, download and print the documents and information of the Site at any moment. Any use of the aforementioned rights must be abandoned immediately after a written notice from Mobiletag.
The rights accorded to you constitute a license and not a property transfer.
The rights mentioned above concerning the consultation, download and printing of the documents and information proposed on the Site do not apply to the design and page layout of the Site. The elements of this Site are protected by the law concerning the presentation of commercial articles and other laws; they can not be copied or limited partially or totally.

Excluding special contrary indications in a written agreement between you and Mobiletag, or in virtue of the law in force, all materials, services, software and content is provided "as is" and "as available" for your use. The software and content is provided without warranties of any kind, either special or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by law, in no event shall MTAG or any of its affiliates guarantee that (i) the services and materials will fulfil your demands, (ii) that the services and materials will be available without interruption, opportune and without errors, (iii) that the results obtained by the use of materials and services will be efficient, exact and reliable, (iv) that the quality of all the products, services or information obtained on the Site will fulfil your demands, and (v) that the software errors obtained on the Site will be corrected. For certain countries and jurisdictions that do not authorise the tacit guarantee exclusion or the limitation of the duration of the tacit contracts, the preceding limitations might not apply to your case. Insofar as these limitations are authorised, the tacit guarantees will be limited to ninety (90) days.

PERSONAL AND CONFIDENTIAL INFORMATION
If any of the mobiletag services requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify MTAG immediately of any unauthorized use of your account or any other breach of security. MTAG will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by MTAG or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.
Mobiletag personal data includes all the information concerning you as a natural person that you supply us with voluntarily or that we collect within the framework of your navigation and that, whatever the nature, allows us to identify you directly or indirectly. This personal data regroups both "nominated data" and "electronic identification data".
- Nominative data: personal information that you supply us with when creating a Mobiletag account to access our services. This page is inaccessible to other Internet users. This information is not public, but you can add other data associated to your account
- Electronic identification data: information created or calculated on or from your computer, during your connexions to the Internet and that allows you to identify yourself as an Internet user. This data is thus only eventually nominative: it does not allow, on its own, you identification

Account inactivity
After one (1) year of inactivity, your Mobiletag account may be deleted at any moment, without prior notice. You will thus lose your username, which may be reassigned to another Internet user. After this one year delay, you may not be able to access (i) neither the Mobiletag services that demand opening an account, (ii) nor different content/information that you could have stocked on these services. You can not reclaim your username.
This rule applies to Mobiletag accounts, specific rules, especially concerning the web tag, SMS tag, or other services may cause a faster deletion of your contents concerning these services.
Data sharing and disclosure
In no case will Mobiletag share or disclose personal data, except (i) when you have given us your prior consent to share this information; (ii) when we must share this information with our providers, recipients and especially with our technical providers, vendors, biers, in order to allow you to use or to supply you with a service that you have demanded; (iii) when we are obliged to do so by a judicial authority or law; (iv) when, for management or gathered information treatment, for preservation and security reasons, your data is transferred to the servers.

Mobiletag reserves the right, for good means of service use, to place "cookies" on your computer and to access them.
WEB MARKERS
Mobiletag uses web markers to access the cookies used on its proper web sites network by different products and services.
You have the right of general access, of rectification and deletion of the totality of your personal data concerning you that have been collected to account for your use of the Mobiletag services. You have direct online access to the majority of your personal data.

In order for us to be able to satisfy your demand, you must provide us with the necessary details concerning your identification as an account holder (account name, date of birth, country, postal code, email address, a written attestation certifying that you are the account holder, as well as a photocopy of your ID and a proof of address dating from less than three (3) months.
The data may be however conserved in our archives for a limited period of ninety (90) days in order to prevent illicit behaviour after the deletion of your account.

These Terms of Use and your use of the Mobiletag Website and Services shall be governed and construed in accordance with the laws of France. You agree that for any matter arising out of or relating to these Terms of Use shall be carried out in courts and legal tribunals located in Paris, France.
